Media Futures Market B.V. (Media Futures Market) is a tech company that connects advertisers and media owners to buy and sell advertisements in various media segments: television, online video, display, radio, outdoor and print. Embracing transparency, Media Futures Market has developed an independent online platform (the Platform) on which Advertisement products are offered. Furthermore, the Platform provides a personal real-time dashboard that keeps track of all Advertiser’s actions and of Media owner’sAdvertisement Contracts and the status thereof (the Dashboard) (collectively:our Services). The Platform is available via a website: https://www.mediafuturesmarket.com (the Website).
Please note: our Services are offered only to parties that act in a commercial or professional capacity, for purposes in connection with trade, business, craft or professional activity. Consequently, an Advertiser on our Platform cannot be considered a consumer (consument), nor can any purchase via our Platform be considered a consumer purchase (consumentenkoop).
Excluding any conditions or stipulations of third parties or any other party, these terms and conditions (Terms)apply to all use of our Services by Advertisers and Media owners. Media FuturesMarket offers its Services on the condition that Media owner/Advertiser accepts these Terms. Media Futures Market may amend these Terms. The latest version of the Terms always applies to the relationship between Media Futures Market and the Media owner/Advertiser.
1.1 Media Futures Market: Media Futures Market B.V., a limited liability company incorporatedunder Dutch law, having its registered office at KNSM-Laan 171, (1019 LC) Amsterdam, and registered in the trade register of theDutch Chamber of Commerce under number 80800475. In these Terms, Media FuturesMarket is also referred to as we andour.
1.2 Advertiser: the commercial entity that createdan Account on the Platform with the purpose to discover advertising productsand engage with Media owner via the Platform.
1.3 Media owner: the commercialentity that created anAccount and offers and sells Advertising products to Advertiser via thePlatform.
1.4 Platform Agreement Media owner: the agreement between Media Futures Market andthe Media owner, to which these Terms apply, including any amendment or supplement thereto.
1.5 Platform Agreement Advertiser: the agreement between Media Futures Market and the Advertiser, and to which these Terms apply, including any amendment or supplement thereto.
1.6 Onboarding Process: the online onboarding process via the Website for Advertisers and Media owners to gain access to the Platform and make use of the Services of MediaFutures Market.
1.7 Account: theAccount on the Platform that Media owner/Advertiser has created, which is limited for use by Media owner/Advertiser via the Login Credentials.
1.8 Offer: aspecific offer, consisting of Advertisement products, made by Media owner on the Platform.
1.9 Advertisement Product(s): all advertisement products, related to advertisements in various mediasegments, including but not limited to, television, online video, display, radio, outdoor and print, offered by Media owner to Advertisers via the Platform.
Advertising Purchase Agreement: shall have the meaning given thereto in clause 7.1.
1.1 Anyoffers and quotations from Media Futures Market are without obligation, unlessagreed otherwise in writing. No rights can be derived from an offer orquotation for a future Platform Agreement Media owner/Advertiser.
1.2 Anoffer or quotation is based on a specific request from Media owner/Advertiserand only applies to the specific underlying Platform Agreement Media owner/Advertiser.On preparation of the quotation, Media Futures Market may assume that the dataprovided by Media owner/Advertiser is correct and complete.
1.3 Allimages, specifications and details in offers and quotations are indicative andcannot be a reason for compensation of damages or termination of the PlatformAgreement Media owner/Advertiser.
